Terms of Use for Baby Monitor Smart Remote

These Terms of Use ("Terms") apply to the Baby Monitor Smart Remote mobile application, the website at https://babymonitor.ewstechnology.com, the server API at srv.babymonitor.ewstechnology.com, and related connectivity, relay, support, feedback, and website services (together, the "Service").

The Service is operated by EWS TECHNOLOGY LTD ("Baby Monitor," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Important Safety Notice: Not a Substitute for Supervision

Baby Monitor Smart Remote is a monitoring aid only. It does not replace direct adult supervision. A parent or legal guardian must remain close enough to hear the child and physically check on the child whenever needed. You are responsible for your child's safety at all times.

Do not rely on the app as your only method of supervision, and do not use it as an emergency service, medical device, life-safety system, security system, or substitute for professional care.

The app may help you watch, listen, receive alerts, and check a paired Baby device from a paired Parent device. However, the app can be delayed, interrupted, unavailable, or incorrect. If you think the child may need help, check the child directly and contact local emergency services or a qualified medical professional where appropriate.

When using the app, you must stay nearby, such as in the next room or another place where you can hear what is happening and can quickly check the child in person. The app must never be used as the only way to supervise a child.

2. What Baby Monitor Smart Remote Does

Baby Monitor Smart Remote helps an adult parent or legal guardian use trusted mobile devices as a private baby monitoring aid.

Baby Mode runs on a device placed near the child. Depending on settings, Baby Mode may send live video, photo frames, and audio to an authorized Parent device, perform local cry detection, send alerts, play white noise, and allow limited remote control of safe app settings.

Parent Mode runs on the adult's device. Depending on settings, Parent Mode may let the adult watch, listen, talk back to the Baby device, receive cry, battery, or device health alerts, switch video, audio, or photo modes, manage selected Baby device settings, and save local photos or videos chosen by the user.

Night Mode is designed to reduce visual streaming and power use during overnight monitoring. In Night Mode, video or photo streaming may be disabled while audio monitoring and cry detection may remain available if enabled and working.

White Noise lets the user play downloaded MP3 tracks locally or on the Baby device under Parent control.

The Service may use local network connections, Wi-Fi, mobile networks, Router Direct or NAT traversal where supported by a compatible router, and SRV/Tunneler relay infrastructure. The app does not create personal user accounts. It uses pairing between trusted devices through a short-lived QR pairing flow.

The Service is not a professional baby monitor, medical device, emergency alert service, childcare service, or security system.

3. Adult Use and Responsibility

The Service is intended for adult parents and legal guardians. A trusted adult caregiver may use the Service only with permission from the parent or legal guardian and only where such use is lawful.

Children must not manage Baby or Parent pairing, send feedback, submit contact details, or share QR or pairing information.

By using the Service, you confirm that:

  • - you are an adult or have reached the age of majority in your jurisdiction;
  • - you have legal authority to monitor the child and to configure the devices used with the Service;
  • - you will use the Service only in a lawful and safe way;
  • - if you authorize another adult, you are responsible for making sure that person understands and follows these Terms;
  • - you will not use the Service in any situation where direct physical supervision, medical supervision, emergency response, or professional care is required.

Using the app while an adult is sleeping does not remove the adult's responsibility to provide safe supervision and to remain able to hear and check the child without relying only on the app.

4. Safe Device Placement and Use

You are responsible for safely placing, charging, and using all devices and accessories.

You must:

  • - check the child personally and regularly;
  • - test the devices before important use;
  • - make sure both devices are charged, connected, unlocked or configured as needed, and showing the expected status;
  • - keep the Baby device out of the crib, bassinet, bed, blanket, and the child's reach;
  • - keep charging cables, chargers, stands, tripods, mounts, and accessories away from the child;
  • - avoid overheating, unstable placement, falling devices, blocked microphones, blocked cameras, excessive brightness, excessive flashlight use, and excessive volume;
  • - set the Parent device volume so that an adult can actually hear important sounds;
  • - check camera, microphone, local network, notification, photo/media, and storage permissions;
  • - check operating system settings such as Do Not Disturb, Focus modes, notification permissions, battery saver, background restrictions, cellular data, Wi-Fi, and network restrictions;
  • - immediately check the child in person if the connection drops, video or audio is delayed, sounds are unusual, alerts do not arrive, the app behaves unexpectedly, or you are unsure about the child's condition.

Do not place a device where it could injure the child, distract the child, interfere with breathing or sleep safety, create a cable hazard, become too hot, or expose the child to unsafe sound or light.

5. Pairing, QR Codes, and Authorized Users

The app works without ordinary user accounts, but pairing creates a trusted access relationship between a Baby device and one or more Parent devices.

QR codes, pairing tickets, pairing links, pairing tokens, and pairing data are access credentials. Treat them like passwords.

Do not share a QR code or pairing access with anyone except a trusted parent, legal guardian, or caregiver who is allowed to monitor the child.

You must not publish, forward, screenshot for sharing, photograph for sharing, or leave pairing codes visible to unauthorized people. You are responsible for actions taken from Parent devices that you authorize.

Pairing QR tickets are short-lived. A QR/pairing ticket may live for up to 5 minutes while the pairing QR screen remains open. If the QR screen is closed, the app may revoke the ticket after about 10 seconds. If Baby Mode exits, the active ticket is revoked immediately.

If a device is lost, stolen, sold, given away, shared with another person, or no longer trusted, you must delete or revoke pairing access in the app as soon as possible.

Inactive pairings and related connection records may be automatically removed after approximately 90 days of inactivity. The app and server may update current connection data on new connections and overwrite old operational status data instead of keeping duplicate history.

We may restrict, revoke, or block suspicious access where we believe it is necessary to protect the Service, users, children, devices, or infrastructure.

6. Monitoring, Recording, Talk-Back, and Consent

The Baby device may send live video, photo frames, and audio. The Parent device may send talk-back audio to the Baby device. The Parent device may allow the user to save local photos or videos from the received stream.

Local photos and videos saved on a Parent device are controlled by you and your device operating system. You are responsible for storing, deleting, sharing, backing up, or protecting those files.

You are responsible for the legality of watching, listening, recording, storing, and sharing any video, audio, photo, or talk-back content. You must obtain all permissions or consents required by law from adult caregivers, household members, visitors, employees, or any other person who may be captured by the camera or microphone.

Do not use the Service for hidden surveillance, unlawful recording, stalking, harassment, coercive control, blackmail, monitoring people without a lawful basis, or any violation of privacy rights.

Do not use the Service to create, store, transmit, request, or distribute illegal, harmful, exploitative, abusive, intimate, or sexual content involving children or any other person. If we become aware of misuse, we may restrict access, preserve or process relevant records where permitted or required by law, and report to appropriate authorities where legally required or necessary to protect safety.

7. Cry Detection, Night Mode, and Notifications

Cry detection may help identify likely crying sounds on the Baby device, but it can miss events or trigger alerts when the child is not crying. You must not rely on cry detection as your only way to monitor the child.

Cry detection runs locally on the Baby device. It may be affected by distance from the child, background noise, white noise, music, other voices, microphone quality, blocked microphones, device quality, battery saver, operating system restrictions, disabled permissions, poor network conditions, or app/device state.

Cry detection and notifications may miss events, trigger incorrectly, arrive late, or fail. A test notification does not mean all future real alerts will be delivered.

Night Mode is designed to reduce visual streaming and power use, but it does not ensure overnight monitoring. A device may still lose power, overheat, lose network connectivity, be stopped by the operating system, lose permissions, or fail to send or receive alerts.

Push notifications are not controlled only by us. They may be delayed, blocked, suppressed, or unavailable because of your operating system, notification settings, Focus or Do Not Disturb modes, battery settings, network, Firebase Cloud Messaging, Apple Push Notification service, device state, or other factors.

You must not rely on notifications as the only way to know whether the child needs attention. If connection, sound, video, alerts, or app status are unclear, check the child directly.

8. Connectivity, Availability, and Updates

The Service depends on many factors outside our full control, including:

  • - Wi-Fi, cellular, 5G, LTE, 3G, 2G, local network, router, and internet quality;
  • - router compatibility and settings, including UPnP, NAT-PMP, PCP, port rules, firewall, and NAT behavior;
  • - carrier NAT, VPNs, proxies, captive portals, blocked TCP or UDP routes, and network filtering;
  • - battery level, charging state, overheating, app closure, force-stop, system cleanup, and device sleep behavior;
  • - operating system background limits, notification permissions, Focus or Do Not Disturb modes, and battery optimization;
  • - Firebase, FCM, APNs, SRV, Tunneler, Stripe, hosting, DNS, CDN, app store, and other provider availability;
  • - app version, operating system version, hardware limitations, bugs, and app store policies.

To establish, maintain, or improve a Baby Monitor connection, the app and Service may open TCP or UDP connections, send and receive generated connectivity test traffic, measure route availability, latency, transfer speed, throughput, and estimated available bandwidth, and select or switch between available routes. Measurements from one test or connection may be used to direct, distribute, or reroute other authenticated Baby Monitor connections within the same authorized Baby Monitor session to improve overall speed, reduce congestion, or use a faster working route. These operations may occur automatically.

These features are intended only for Baby Monitor connectivity and authorized service diagnostics, not to provide a public proxy, carry unrelated third-party traffic, or move traffic between unrelated Baby Monitor sessions. Testing and rerouting may temporarily use Wi-Fi or mobile data and reduce bandwidth available for other activity. Your carrier or network provider may charge you for data use. Test results are estimates and do not guarantee any connection method, speed, bandwidth, latency, availability, or monitoring quality.

Monitoring, streaming, QR pairing, direct routing, relay routing, alerts, and notifications may be delayed, interrupted, unavailable, or fail. Network fallback, Router Direct, local network connection, or relay availability is not promised.

We may update, change, limit, temporarily disable, or remove features. Some features may require a newer app version. If server-side components change, old app versions may show a force update prompt or may not work correctly until updated. We are not required to support old app versions, unsupported devices, old operating systems, or incompatible networks indefinitely.

9. End-to-End Encryption and Security

In the standard production configuration, live Streamer payloads for video, photo frames, audio, talk-back audio, and Streamer control commands are end-to-end encrypted between paired Baby and Parent devices where supported by the current app. This includes local network, router direct, SRV/Tunneler relay, TCP fallback, and UDP fallback routes.

The live Streamer payload is encrypted before it enters the C Streamer/Tunneler path using a per-pair stream end-to-end encryption key. Older pairs that do not have this key may need to be paired again using the QR pairing flow.

Our SRV/Tunneler infrastructure does not have the live Streamer decryption key and is not intended to read video, photo, audio, talk-back audio, or encrypted Streamer control command contents. The server may still process operational metadata needed for routing, authorization, diagnostics, alerts, and abuse prevention, such as Baby and Parent identifiers, session status, online/offline status, streaming status, route type, Tunneler node, country code/source, timestamps, push events and receipts, support records, and feedback records.

End-to-end encryption for the live monitoring payload does not apply to all data. Feedback attachments, support payments, analytics, push tokens, device metadata, website data, and other non-live-stream data are handled as described in our Privacy Policy.

No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. End-to-end encryption reduces risk, but it does not prevent all possible problems, including device compromise, malware, weak device passcodes, screenshots, local recordings, shared QR codes, unauthorized physical access, operating system bugs, network attacks, user mistakes, or misuse by an authorized person.

You are responsible for protecting your devices, screen locks, operating system accounts, networks, routers, app permissions, QR codes, and pairing access.

10. White Noise

White Noise is an optional comfort and playback feature. It is not medical advice, sleep training advice, treatment, diagnosis, or a promise that a child will sleep.

You are responsible for choosing tracks, setting volume, placing the device safely, and making sure white noise does not prevent an adult from hearing the child or other important sounds.

Downloaded white-noise files may be stored locally until you delete them, clear app data, or uninstall the app.

11. Feedback and Support

Feedback is optional. You may submit feedback through the app or website. Feedback may include message text, a selected photo or video attachment, and technical metadata about the app, device, operating system, language, browser, or request.

Do not send other people's personal data, confidential information, child images, child video, child audio, sensitive information, or private materials through feedback unless it is necessary for your request and you have the right to send it.

By sending feedback or an attachment, you confirm that you have the right to provide it. You allow us to use feedback to respond, diagnose issues, improve the Service, protect safety and security, and prevent abuse, as described in the Privacy Policy.

Feedback is not an emergency support channel. If a child or any person may be in danger, contact local emergency services or a qualified professional immediately.

12. Voluntary Website Support Payments

The app can be used without making a support payment. Support payments do not unlock monitoring features, subscriptions, priority service, higher reliability, extra alerts, or additional monitoring capability.

At this time, Stripe support payments are not part of the production app payment flow. The app's Support Development path may redirect to feedback/contact. If a voluntary support payment page is available directly on the website, it is website-only voluntary support.

If you choose to make a voluntary support payment, payment card data is processed by Stripe Checkout. We do not store your card number, CVC, or full bank details. We may store payment-related records such as amount, currency, payment status, Stripe session ID, Stripe payment ID, refund or dispute status, and installation hash, as described in the Privacy Policy.

Payment issues, refunds, and disputes may be handled through Stripe, your bank, card provider, and applicable law. Contact us at babymonitor@ewstechnology.com for support payment questions.

If a support payment is connected to an installation identifier, it may be used to avoid showing repeated support prompts to the same installation after a successful status. It does not change monitoring functionality.

If direct payment flow from the app is added in the future, these Terms, app store disclosures, and payment flow wording may be updated before release.

13. Privacy and Cookies

Your use of the Service is also subject to our Privacy Policy and Cookie Notice.

The Privacy Policy explains how we handle device identifiers, pairing and session data, live media, push tokens, analytics, feedback, support payments, retention, deletion, service providers, and privacy rights.

The Cookie Notice explains website cookies and similar technologies, including localStorage, Firebase Analytics / Google Analytics after consent, and user choices.

14. Third-Party Services

The Service may use or interact with third-party services, including:

  • - Apple App Store, TestFlight or App Store infrastructure, iOS, and Apple Push Notification service;
  • - Google Play, Android, Firebase Analytics, Firebase Installations, Firebase Messaging / FCM, and Google/Firebase infrastructure;
  • - Stripe Checkout for voluntary website support payments where available;
  • - hosting, DNS, CDN, email/contact, and server infrastructure providers;
  • - our own SRV and Tunneler nodes used for Baby Monitor connectivity;
  • - external app stores or platform pages after you click store links.

Third-party services may have their own terms, privacy policies, outages, delays, errors, and rules. You must also follow the rules of your app store, device operating system, network provider, and payment provider. We do not control all third-party provider decisions, outages, delays, policies, or errors.

15. Acceptable Use

You must use the Service only for lawful personal baby monitoring by an adult parent, legal guardian, or authorized adult caregiver.

You must not:

  • - use the Service for unlawful surveillance or recording;
  • - use the Service as a tool for stalking, harassment, coercive control, abuse, exploitation, blackmail, or privacy violations;
  • - use the Service to harm a child or another person;
  • - create, store, transmit, request, or distribute child sexual abuse material or any illegal or exploitative content;
  • - share QR codes, pairing access, or access credentials with unauthorized people;
  • - try to bypass pairing, authorization, encryption, access controls, app protections, or server limits;
  • - reverse engineer, decompile, tamper with, attack, scan, scrape, overload, automate, or interfere with the app, website, SRV, Tunneler, other users, or other devices, except where such activity is expressly allowed by applicable law;
  • - run load tests, vulnerability scans, scraping, bots, or automation against the Service without our written permission;
  • - impersonate another user, developer, support person, caregiver, parent, or legal guardian;
  • - violate intellectual property rights, privacy rights, app store rules, export controls, court orders, childcare policies, workplace rules, facility rules, or applicable laws;
  • - use the Service where its use is prohibited by law, a court order, a childcare provider, an institution, an employer, or another binding policy.

16. Device Permissions and User-Controlled Data

You control app permissions through your device operating system, including camera, microphone, local network, notifications, photo/media, and storage permissions where applicable.

If you disable a required permission, related features may not work or may work only partly.

Deleting the app, clearing app data, or deleting a pair may remove local settings, downloaded white-noise files, pairing state, and access. Locally saved photos and videos outside app cache are controlled by you and your operating system.

Android, iOS, device backups, cloud backups, and device transfer systems may treat sensitive app data differently depending on platform rules and device settings.

17. App Stores and Platform Terms

If you download the app through Apple App Store, Google Play, or another app store, you must also follow that store's rules and terms.

Apple, Google, and other platform providers are not parties to these Terms between you and EWS TECHNOLOGY LTD except where their store terms or required platform terms apply. They are not responsible for our Service, support, maintenance, content, privacy practices, or claims, except where applicable platform terms say otherwise.

For iOS users, the license granted in these Terms is limited to use on Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and applicable Apple rules. Apple and Apple's subsidiaries are third-party beneficiaries of the iOS-related parts of these Terms and may enforce those parts where applicable.

For Google Play users, your use of the app must comply with applicable Google Play terms, Android platform rules, and store policies.

The app is intended for adult parents and legal guardians, not as a child-directed app for children to use independently.

18. Intellectual Property and License

The app, website, software, code, user interface, graphics, names, logos, designs, text, media, service names, and other content are owned by EWS TECHNOLOGY LTD or used under license.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and website for lawful personal baby monitoring by an adult parent, legal guardian, or authorized adult caregiver.

You do not receive ownership rights in the app, website, code, design, assets, or Service.

Apple, Google, Android, iOS, App Store, Google Play, Stripe, Firebase, and other third-party names, marks, and badges belong to their respective owners.

If you send suggestions, ideas, feedback, or improvement requests, you allow us to use them to improve the Service without paying you or owing you any obligation, unless applicable law requires otherwise.

19. Suspension and Termination

You may stop using the Service at any time by deleting the app, deleting pairs, revoking access, clearing app data, or stopping use of the website.

We may suspend, limit, revoke, or terminate access to server-side services if we believe you violated these Terms, created a safety or security risk, abused the Service, attacked infrastructure, violated law, infringed rights, shared unauthorized access, or created risk for another person.

A restriction on server-side access may affect pairing, relay, notifications, feedback, support status, and other online features.

Some records may be kept for the periods described in the Privacy Policy for security, abuse prevention, diagnostics, legal, accounting, tax, refund, dispute, or compliance purposes.

20. Disclaimers

The Service is provided as a helpful tool, not as a promise of safety. To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available."

We do not promise uninterrupted, error-free, or continuous operation. We do not promise detection of crying, delivery of notifications, connection availability, audio or video quality, device compatibility, router compatibility, battery life, security, or successful relay/direct routing.

We do not provide medical, childcare, emergency, security, sleep training, parenting, or professional advice. The Service is not intended to prevent harm, illness, accident, injury, emergency, or death.

You must use your own judgment, supervise the child directly, and seek emergency, medical, childcare, or professional help where appropriate.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws that cannot legally be limited or excluded.

21. Limitation of Liability

To the maximum extent permitted by applicable law, EWS TECHNOLOGY LTD and its directors, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost profits, service interruption, device failure, network failure, notification delay, notification failure, or damages arising from misuse of the Service.

You remain responsible for the child's safety at all times. We are not responsible for a user's decision to rely on the app as the only method of supervision, to ignore direct checks, to place devices unsafely, to disable permissions, to use unsafe cables or chargers, to share pairing access, or to use the Service unlawfully.

We are not responsible for outages, delays, blocked notifications, network or router failures, operating system restrictions, dead batteries, overheating, app force-stop, background limits, disabled permissions, third-party provider outages, or user misuse, except to the extent liability cannot be excluded by law.

We are not responsible for unlawful recording, unlawful monitoring, unauthorized QR or pairing sharing, local saved photos or videos, or content shared by users.

Some jurisdictions do not allow certain exclusions or limitations. In those places, the limitations apply only to the extent permitted by law.

22. Indemnity and User Responsibility

Where permitted by applicable law, you are responsible for claims, losses, fines, damages, costs, or disputes arising from your unlawful monitoring, unlawful recording, unauthorized sharing of QR or pairing access, misuse of the Service, violation of laws, violation of third-party rights, unsafe device placement, unsafe charging or accessories, or breach of these Terms.

This section does not limit mandatory consumer rights that cannot be waived under applicable law.

23. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above.

If changes are material, we may provide additional notice through the website, the app, or other reasonable means. Your continued use of the Service after updated Terms become effective means you accept the updated Terms, unless applicable law requires another method of consent.

24. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, except that mandatory consumer protection laws in your country, state, or region may still apply where they cannot legally be excluded.

The courts of England and Wales will have non-exclusive jurisdiction over disputes related to these Terms, except where you have mandatory rights to bring claims in the courts of your country, state, or region.

We do not include a mandatory arbitration clause or class action waiver in these Terms.
